China publishes white paper on export controls for the first time
On 29th Dec. 2021, China’s State Council Information Office published a white paper titled “China’s Export Controls”. The white paper aims to provide a full picture of China’s policies on export controls and to address China’s commitment and action on safeguarding world peace and development, as well as national and international security. The white paper on export controls consists of following chapters:
Preamble
I. China’s Basic Position on Export Controls
II. Ongoing Improvements to the Legal and Regulatory System for Export Controls
III. Modernizing the Export Control System
IV. Promoting International Exchanges and Cooperation
Conclusion
According to the definition in the white paper, export controls involve prohibitive or restrictive measures on the export of dual-use items, military products, nuclear materials and other goods, technologies and services related to safeguarding national security and interests.
What does that mean to the export control of certain chemicals?
Chapter II part 2 of the white paper elaborates on the regulatory system for export control of dual-use items. Export of dual-use items related to certain chemicals is regulated by the Ministry of Commerce. For the export of controlled chemicals, China’s Ministry of Industry and Information Technology (MIIT) is responsible for undertaking specific export review. The MIIT also regulates exporter accreditation jointly with the Ministry of Commerce.
